LEGAL METROLOGY

LMPC certification stands for Legal Metrology Packaged Commodities Registration Certificate. Legal metrology means that part of metrology which treats units of weighment and measurement, methods of weighment and measurement and weighing and measuring instruments, in regard to the mandatory technical and legal requirements which have the objects of ensuring public guarantee from the point of view of security and accuracy of the weighments and measurements.

RULE 27 of Packaged Commodities Rules, 2011 (LMPC): Every individual, firm, Hindu undivided family, society, company or corporation who or which pre-packs or imports any commodity for sale, distribution or delivery shall make an application for LMPC, accompanied by a fee of rupees five hundred, to the Director or the Controller for the registration of Person as an Importer or Manufacturer and Packer of Pre-packaged commodities.

Under the Department of Consumer Affairs, Legal Metrology is a wing which was established in 2009 that is engaged in monitoring and regulating the manufacturing, importing, and other businesses engaged in weighing and measuring instruments and devices.

WHO WILL ISSUE LMPC CERTIFICATE?

The application for the registration is made to the Controller of Legal Metrology in the State. The application is filled along with the documents and required fee after 20 days LMPC Certificate is issued. LMPC Certificate is issued to protect the consumer interest and have fair policies.

WHO NEEDS AN LMPC CERTIFICATE?

WHAT IS THE APPLICABILITY & EXEMPTIONS OF LMPC CERTIFICATE?

• It is clearly mentioned that any violation of the rules of LMPC certificate for import will lead to penalties. Some of these are listed below:
• Any violation of the provisions of rules 21 to 37 will lead to a fine of Rs. 4,000.
• Any violation of the other rules for which there has been no punishment mentioned will lead to a fine of Rs.2000.
• If you fail to apply for LMPC within 90 days from the initiation of import, you will have to pay a late fee.

There are some exemptions for import of the pre-packaged goods, which are as follows:

• Goods or commodities with a net weight or measurement of 10 grams or 10 millilitres or less
• Packages containing fatty food by a restaurant or hotel
• Agricultural products in packages of more than 50kgs
• Packages carrying preparations covered under Drugs (Price Control) Order, 1995

TYPES OF LMPC CERTIFICATE:

There are two types of LMPC certificates under Legal Metrology Pre-Packaged Commodities Rules, 2011-

1. LMPC Importer Registration
2. LMPC Packer & Manufacturer Registration under Rule 27
